This module critically explores the protection of LGBTQ+ Rights, focusing primarily on those rights guaranteed by the European Convention on Human Rights. While there have been some notable successes in LGBTQ+ rights litigation, there are also anti-LGBTQ+ rights claims and critiques of using rights claims to secure progressive social change, which we will consider in this module. Drawing on feminist and queer theoretical frameworks, we will examine in their historical and social context issues such as anti-discrimination provisions, gender identity, and the recognition of LGBTQ+ relationships and parenting. We will also consider the relationship between LGBTQ+ rights, religious rights, and freedom of expression and assembly, as well as the principle of non-retrogression and the revocation of LGBTQ+ rights.
