This Critical Approaches to International Criminal Law seminar will assess the role of international law in the war on Gaza also in the context of events in the West Bank and the law of occupation. It will examine the competing legal narratives and consider the capacity of international law to play a meaningful role in regulating the conflict.

Gaza is today a place of unprecedented catastrophe. Following the Hamas attack on 7 October 2023, the Israeli state imposed a complete siege on the Gaza strip, cutting off fuel, food and water and ordered the evacuation of civilians from Northern Gaza. Both the siege and the evacuation order have been deemed incompatible with international law. In the weeks that have followed, Israel has bombarded the Gaza strip leading to, as of 12 November, over 11,000 fatalities. 70% of Gaza’s population is internally displaced. The health system has collapsed and dehydration, starvation and disease are now widespread.

Israel’s leaders have been candid about their intentions in besieging and bombing Gaza. The Minister of Defence, Yoav Gallant, announcing the siege, said “[t]here will be no electricity, no food, no fuel, everything is closed. We are fighting human animals and we are acting accordingly”. A spokesperson for the Israeli military said that the emphasis was “on damage and not accuracy”, and another official stated that “[c]reating a severe humanitarian crisis in Gaza is a necessary means to achieve the goal”. For their part, many Western leaders have shown unwavering support for the Israeli state’s actions. Other world leaders, international organisations, non-governmental organisations and experts have decried serious violations of international humanitarian law, the commission of war crimes and what is now widely recognised as an unfolding genocide.
